Council denies re-split of Ridge Road lot
A proposed lot split on Ridge Road near the Garden of the Gods will not happen. City Council voted unanimously July 12 to deny an appeal of City Planning
Commission's June decision opposing the plan.
The .58-acre property was originally platted for two lots of about the same size in 1980, but was combined to one lot in 1994. The current owner, Jacquelyn Byrd, had sought to resplit the lot, making the second lot smaller because a house now sits on parts of both the original lots.
Opponents had argued that carving out a new lot would be against the spirit of the lot assimilation that had previously occurred. They reportedly had signatures against the plan from everyone in the immediate neighborhood. City Planning staff had recommended approval because the proposal met all the legal requirements for the R-5 zone it's in, and the smaller lot would still be typical of those in an area broader than just that immediate neighborhood.
The denial motion was made by Councilman Scott Hente, whose district includes that area. Calling it “one of the strangest land-use items that's come before City Council,” he said he believed the proposed split would prove adverse to the neighborhood.
